Seven-Judge Bench Holds the Arjun Flour Mills Reference Academic After GST
A seven-judge Constitution Bench headed by Chief Justice of India Surya Kant held on 4 November 2026 that a reference pending since the late 1990s, on the power of States to impose an additional sales tax or surcharge calculated on existing sales tax, has become academic after the introduction of GST, LiveLaw reported. The Bench had reserved its verdict on 22 September 2026.
- The case: Arjun Flour Mills v. State of Odisha challenged Section 5A of the Odisha Sales Tax Act, 1947, introduced in 1997, which imposed an additional tax of 10% on dealers with an annual turnover between Rs 10 lakh and Rs 1 crore, and 15% above Rs 1 crore.
- The question: whether such a levy fell within the States’ taxation powers under Entry 54 of List II of the Seventh Schedule, as it then stood, or encroached on Parliament’s power to tax income under Entry 82 of List I.
- The answer: “The constitutional entry and the state enactments under which the impugned levies were imposed have since been substituted or replaced, and the question referred to is of no prospective significance”, the order said, as quoted by LiveLaw. The reference was “answered as having been rendered infructuous”.
- The clarification: LiveLaw reported that the Court clarified that an additional tax or surcharge computed as a percentage of the sales tax payable is an enhancement of the rate of sales tax and remains a tax on the sale or purchase of goods within the then Entry 54 of List II. The Punjab questions and the other contentions in the individual matters were left open.
- Separate opinion: Justice K.V. Viswanathan held that S. Kodar v. State of Kerala was correctly decided and continues to be good law, and found no conflict between Kodar and Hoechst Pharmaceuticals.
📌 Facts Corner
- Outcome: the seven-judge reference on additional tax over sales tax was held academic on 4 November 2026 after GST.
- Provision in question: Entry 54, List II, Seventh Schedule, as it then stood; Section 5A, Odisha Sales Tax Act, 1947.
- Trap: the reference was answered as infructuous, yet LiveLaw reported a clarification that such a levy remains within the then Entry 54; the Court did not strike it down.
India Releases the I-OECM Guidelines 2026 at CBD COP-17 in Yerevan
The Union Environment Minister released the Guidelines for the designation of India’s Other Effective Area-Based Conservation Measures (I-OECMs) 2026 at a side event of the 17th Conference of the Parties to the Convention on Biological Diversity (CBD COP-17) in Yerevan, Armenia, on 3 November 2026, PIB said. An earlier deep dive covered India’s national statement at the same conference.
- What they do: give a framework for recognising and reporting areas outside legally protected and conserved areas that deliver long-term in-situ conservation of biodiversity. They were prepared by the Ministry of Environment, Forest and Climate Change (MoEFCC) with the National Biodiversity Authority (NBA), and support Target 3 (30x30) of the Kunming-Montreal Global Biodiversity Framework.
- Illustrative sites: biodiversity parks, sacred groves, community-managed irrigation tanks, seagrass and seaweed beds, and fisheries seasonal ban areas.
- Four mandatory criteria: the area is not legally protected or conserved; it is governed under Central or State frameworks or by government-recognised local institutions such as Panchayats and Biodiversity Management Committees; it has defined boundaries and no overlap with the World Database on Protected Areas; and recognition does not alter its existing activities, governance or regulatory regime.
- The route: applications go to the NBA, which forwards them within 30 days to the State Biodiversity Board or UT Biodiversity Council; that body sends its recommendation within 30 days; the NBA decides in coordination with MoEFCC, which authorises recognition.
- The GEF-8 project: runs from 15 May 2026 to 15 May 2032 with total financing of USD 60.79 million in six demonstration landscapes and seascapes. It aims to add 3 per cent of India’s land and marine area to the conservation estate, over and above the existing 27 per cent under protection.

- Cancer medicines: 30% of MRP trade margin cap on 137 non-scheduled medicines; revised prices from 9 November 2026.
Prelims, the traps:
- Centrally Sponsored or central sector: the FTSC scheme is Centrally Sponsored, with Central and State/UT shares; VISTAR is a central sector scheme.
- Academic, with a clarification: the reference was answered as infructuous, and LiveLaw reported that the Court clarified such a levy remains within the then Entry 54.
- Recognised, not protected: I-OECM recognition does not make an area a protected area or change its ownership.

- Dated, not in force: IRDAI’s circular is dated 2 November; the four-layer policy comes into force on 15 December 2026.
Mains, arguments and keywords:
- Justice for children and women: dedicated courts, exclusive POCSO Courts and the Nirbhaya Fund as a funding line for faster trials.
- Fiscal federalism after GST: why a long-pending question on State taxation power lost its prospective significance.
- Other effective conservation: reaching area targets through community-managed and sacred sites without changing ownership or legal status.
- Climate finance: India’s case that finance is an obligation of developed countries and must be predictable, largely public and concessional.
- Mineral security: import dependence at the refined stage, and a least-cost capital subsidy as the policy response.
- Statistics as governance: more surveys and a census down to Gram Panchayat and Ward level for evidence-based policy.
- AI in cyber attacks: attack chains running autonomously at machine speed raise the demand on detection and reporting in finance.
Interview, be ready for:
- “How is an OECM different from a protected area?” Recognition reports the conservation value of an area; it leaves ownership and legal status unchanged.
- “Why did a seven-judge Bench answer the reference as infructuous?” The entry and the State laws had been replaced, so the question had no prospective significance; LiveLaw reported that the Court still clarified the Entry 54 point.
