SIR: Justice Bhuyan on Article 326, and the EC’s New Options for Notices

What the judge said. Supreme Court judge Justice Ujjal Bhuyan, delivering the valedictory address at the 19th NALSAR-Justice B.R. Sawhney Memorial Moot Court Competition at NALSAR University of Law, Hyderabad, on 4 October 2026, said any process that disenfranchises millions and makes them “citizens without voting rights” is intrinsically arbitrary and violates Article 326 (adult suffrage) and Article 14 (equality). “No amount of whataboutery can justify it,” he said. In his view, the right to vote is not merely a statutory right but a constitutional right within the Basic Structure, and, except for a dead voter, no name can be deleted without notice and a hearing. He recalled that the Government of India Act, 1935 gave a “partial franchise” based on property, tax, education and other qualifications, covering about 14 per cent of the population. The Hindu puts deletions in the Special Intensive Revision (SIR) so far at about 13.3 crore.

What the EC has changed. The Election Commission has added three options to ERONET, the software Electoral Registration Officers (EROs) use, for the 10 States and UTs in phase 3 of the SIR, The Hindu reported, explained through an eight-minute demonstration video with no written instructions so far:

A case marked “found ineligible” still cannot be reversed. More than nine crore notices have been served in phases 2 and 3. Delhi’s notice phase runs till 30 November and its final roll is due on 4 December; Haryana, Maharashtra and Telangana are due in November and Tripura in February 2027.

The legal position to remember. Justice Bhuyan’s remarks are an extra-judicial speech, not a ruling. The Supreme Court has more often described the right to vote as a statutory right (for example, Jyoti Basu v Debi Ghosal, 1982, and Kuldip Nayar v Union of India, 2006), while some judgments have called it a constitutional right. Article 326 sets the constitutional base: adult suffrage for citizens aged 18 and above, subject to disqualification by law.

GST Council to Meet on 7 October: Process Reforms on the Table

Finance Minister Nirmala Sitharaman, writing in The Hindu, said proposals on registration, returns, refunds, disputes and the smooth flow of input tax credit will be placed before the GST Council on 7 October 2026. She cited the following figures:

Sixth Positive Indigenisation List in the Final Stage

The Defence Ministry has reviewed the sixth Positive Indigenisation List (PIL) of the Department of Military Affairs (DMA), and it is likely to be issued “within a couple of months”, The Hindu reported, quoting a senior official. The list mainly covers Navy and Army items: major Line Replaceable Units (LRUs), sub-systems and assemblies that must be bought from Indian industry once indigenised. It has not yet been notified.

Jaishankar at the Munich Leaders Meeting: “Beyond Advocacy” on Ukraine

Speaking at the Munich Leaders Meeting in New Delhi on 4 October 2026, organised by the Munich Security Conference, External Affairs Minister S. Jaishankar said India was going “beyond advocacy” on the Russia-Ukraine conflict. Swiss President Guy Parmelin on a State Visit, 5 to 7 October

Guy Parmelin, President of the Swiss Confederation, is on a state visit to India from 5 to 7 October 2026 at the Prime Minister’s invitation. He will meet President Droupadi Murmu, hold talks with the Indian leadership and attend the second India-EFTA Prosperity Summit, marking the first year of the India-EFTA Trade and Economic Partnership Agreement (TEPA). Switzerland is India’s largest trade and investment partner in EFTA.

In a column in The Indian Express, Parmelin calls the $100 billion investment and job-creation goal tied to TEPA the figure that will matter most, “the first time an Indian trade agreement has linked market access to a concrete investment goal”, and mentions a Migration and Mobility Partnership and a Young Professional Agreement “to be signed”. Ramappa Temple: Activists Oppose a Coal Mine Five Kilometres Away

Heritage activists, including the Kakatiya Heritage Trust, are demanding the withdrawal of the proposed PVNR opencast coal mine at Venkatapur in Mulugu district, Telangana, which they say threatens the UNESCO World Heritage Kakatiya Rudreshwara (Ramappa) Temple and Ramappa Lake. A delegation met Union Coal and Mines Minister G. Kishan Reddy in Hyderabad on 3 October, and protests from 15 villages are planned after Dasara.

The concern. The mine would lie about 5 km downstream of the lake and temple and go about 300 m deep. Citing a Geological Survey of India report, a former NIT-Warangal professor said lake water could move along lineaments and faults towards the pit, and that this could affect the temple’s sandbox foundation through piping (erosion by seeping water). The activists say the Singareni Collieries Company Ltd (SCCL) is preparing to take up the project; no final decision has been announced, and earlier local reports said it awaited safety assessments.
