The sentence that carries the argument is Foreign Minister Shishir Khanal’s, in an interview with Kantipur TV on September 1: Nepal’s own emissions are “practically negligible”, and “we are shifting our diplomatic framework from aid to justice and compensation. This is not a matter of charity; it is a matter of legal and moral liability.” He named China as the world’s top emitter, the United States second and India third. Prime Minister Balendra Shah has separately called for the compensation issue to be raised more forcefully with the international community.

The disaster, as background. On the morning of August 26, 2026, a wall of water, ice, mud and rock swept down the Trishuli valley in Rasuwa district from the Gyirong (Kerung) border crossing, destroying settlements along about 72 km of river. The precipitating event is now assessed as a glacier collapse on Langtang Lirung: analysis by the United States Geological Survey found that the seismic signal recorded at the time was generated by the collapse itself, not by a tectonic earthquake. Nepal’s National Disaster Risk Reduction and Management Authority reported 1,204 bodies recovered and 4,216 people still unaccounted for as of 6 pm on September 2. Reuters reports the recovery cost at about a tenth of Nepal’s annual economic output. Nepal’s Council of Ministers has decided that the Foreign Minister will attend the 81st session of the United Nations General Assembly, which opens on September 8, and is weighing whether the Prime Minister should go too.

A second track that matters legally. Nepal has also formally approached the Fund for responding to Loss and Damage for urgent assistance, reported as its first ever application to that mechanism. That is a request under the treaty regime; the demand on the three emitters is not, and the distinction is the subject of the next two sections.

Handle the toll numbers with care. The figures have moved with every bulletin: 939 dead in reports of September 1, over 1,000 in Reuters copy the same day, 1,204 in the NDRRMA count of September 2, with the missing variously given as 3,900, 4,216 and 4,500. This edition uses the NDRRMA figure with its date. In an answer, write “over 1,200 dead and about 4,000 missing as of early September 2026”. A precise figure asserted as final is a claim you cannot support.

Why India Is on the List, and Why That Is Uncomfortable

India is named on the basis of aggregate current emissions, being among the world’s largest emitters in absolute terms.

India’s own position in every international negotiation has been the opposite argument, and it rests on three distinctions that are worth writing out precisely because they are exactly what a Mains answer needs:

  • Cumulative against annual. Climate damage is driven by the stock of carbon dioxide accumulated in the atmosphere, not by one year’s flow. India’s cumulative historical share is a small fraction of that of the industrialised countries, whose emissions began with industrialisation.
  • Per capita against total. India’s per capita emissions remain well below the world average and far below those of developed economies. A total-emissions ranking is substantially a ranking by population.
  • Developmental need. A large share of India’s emissions is associated with lifting people out of energy poverty rather than with discretionary consumption.

These are strong arguments, and they do not fully answer Nepal. Nepal’s own submission is that its emissions are “practically negligible” against the global total, and that its per capita emissions are among the lowest in the world. Nepal is therefore making, against India, the same argument India makes against the industrialised world. That symmetry is the intellectual heart of this item. India’s stated position, restated after the demand, is that climate responsibility must reflect historical emissions, development needs and capacity, and that India has supported loss and damage finance for vulnerable countries while pressing developed nations to fund it.

The principle both invoke is Common But Differentiated Responsibilities and Respective Capabilities, in the United Nations Framework Convention on Climate Change of 1992, and carried into the Paris Agreement of 2015 as CBDR-RC “in the light of different national circumstances”. CBDR is not a two-tier rule. It is a gradient, and on a gradient India sits above Nepal and below the industrialised world.

Loss and Damage: the Regime This Claim Enters

Loss and damage is the third pillar of climate action, after mitigation and adaptation. It covers harms that adaptation cannot prevent: a flood that has already happened, a coastline already lost, a glacier already gone.

The trap almost everyone falls into. The decision accompanying Article 8 of the Paris Agreement records that Article 8 does not involve or provide a basis for any liability or compensation. That clause was the price of developed-country agreement to include loss and damage at all. So the loss and damage regime provides a fund, financed by voluntary contributions, and expressly not a compensation mechanism. Nepal’s claim is therefore a political and moral demand made outside the treaty’s liability architecture, not a legal claim under it. Write it that way.

Where a legal route might exist. The International Court of Justice delivered an advisory opinion on the obligations of States in respect of climate change in July 2025, unanimously, following a UN General Assembly request initiated by Vanuatu with a core group of seventeen other States. The Court held that a failure to act on climate change may constitute an internationally wrongful act. An advisory opinion is not binding, but it shapes the interpretation of existing obligations and strengthens the hand of a claimant State arguing that obligations exist independently of the climate treaties.

The Himalayan Physical Problem, Stated Correctly

Glacial retreat creates lakes. Melt collects behind unstable moraine dams of loose rock and ice in young, friable fold mountains. When such a dam fails, the impounded water discharges catastrophically. That is a Glacial Lake Outburst Flood.

Not every Himalayan flood is a GLOF, and this distinction has already cost this site an article correction. A flood can be produced by a glacier or rock-and-ice avalanche entering a valley, by a landslide-dammed lake bursting, or by an extreme rainfall event, none of which is a glacial lake outburst. The Rasuwa event is assessed as a glacier collapse on Langtang Lirung that set off a chain of landslide and flood, which is not the same mechanism as a moraine-dammed lake failing, even though some editorial comment has labelled it a GLOF. Use the specific mechanism if a source names it, and the neutral term flash flood if none does.

One more trap, on the river’s name. Reports call this the Bhote Koshi flood. The Bhote Koshi of Rasuwa is the upper Trishuli, a tributary of the Gandaki (Gandak) system. It is not the Bhote Koshi of Sindhupalchok that feeds the Sun Koshi and the Koshi. Two rivers share the name, and an answer that files this flood under the Koshi basin is wrong.

The regional stake. The Hindu Kush Himalaya spans eight countries: Afghanistan, Bangladesh, Bhutan, China, India, Myanmar, Nepal and Pakistan. Roughly 240 million people live in the mountain region and about 1.65 billion downstream of the major rivers rising there. Projected glacier volume losses run from about 36 to 64 per cent depending on the warming scenario.

The governance gap that matters most. The background, reported by Reuters on August 30: at a meeting in Kathmandu on May 27, 2026, three months before the disaster, ten Nepali officials and about a dozen Chinese representatives, including from Tibet, discussed joint glacial lake inventories and hazard mapping, and that Nepali hydrologists afterwards did not receive the glacier movement and water level data they had asked for; the Chinese side said it lacked the mandate to sign an agreement. China’s embassy says it shared information “in a timely manner”. Nobody has blamed either side for the disaster itself, but the episode shows what transboundary early warning depends on: hydrological data sharing across politically sensitive borders, which no treaty currently obliges.

The way forward that scores avoids both extremes. India should neither accept liability, which would concede the cumulative-emissions argument it needs internationally, nor dismiss the claim, which would cede the moral ground to China in its own neighbourhood. The workable position is generous non-liability assistance: substantial reconstruction support offered as neighbourhood solidarity, an offer of glacial lake monitoring and early warning cooperation where India has real technical capacity, and support for capitalising the Loss and Damage Fund from those with the largest cumulative responsibility.
