Platform Liability

Platform liability refers to the degree to which digital platforms — social media networks, messaging services, video hosting sites, search engines, and online marketplaces — can be held legally accountable for content created and posted by their users (third parties), rather than by the platforms themselves. The answer to this question has enormous consequences: if platforms are fully liable for every piece of user content, they would be forced to pre-screen all posts (making the open internet impossible); if they face zero liability, they have no incentive to remove harmful content. In India, the key legal provision is Section 79 of the Information Technology Act, 2000, which provides 'safe harbour' protection to intermediaries — meaning platforms are generally not liable for third-party content if they do not initiate, select recipients for, or modify the content, and if they comply with government directions to take down content. The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (IT Rules 2021), as amended in 2023, significantly expanded platform obligations — requiring 'significant social media intermediaries' (with over 5 million users) to appoint compliance officers, publish monthly transparency reports, enable message traceability, and create an expedited grievance redressal mechanism. A 'Grievance Appellate Committee' was also established under the 2023 amendment, allowing users to appeal platform content decisions to a government body. The concept of 'design defect liability' emerged as a new frontier in 2025–26 global litigation: whether platforms can be sued not for specific content decisions but for their algorithmic architecture — recommendation engines and engagement maximisation systems that are alleged to amplify harmful content, radicalise users, or fuel addiction. In the US, Section 230 of the Communications Decency Act (1996) has historically given near-absolute immunity to platforms; efforts to reform it have been politically contentious. The EU's Digital Services Act (DSA, 2024) offers a risk-tiered regulatory model increasingly seen as a global template.

In 2023, the Indian government ordered Twitter/X to take down content related to a violent incident under Section 69A of the IT Act. Twitter initially resisted, citing free speech concerns, and challenged the orders before the Karnataka High Court — arguing that the government's blocking process lacked transparency and procedural fairness. This case illustrates the core tension in platform liability: the government's claim of sovereign power to regulate harmful content versus the platform's claim of safe harbour and the user's right to free expression — all mediated through Section 79 and the IT Rules framework.
